An 18-year-old woman said a pair of New York City cops handcuffed her before raping her, including forcing her to perform oral sex on them.
But the cops claim she consented to the sexual acts.
However, it seems highly unlikely that a handcuffed woman can consent to sex with two authority figures threatening to jail her for drugs, which possibly include prescription drugs and/or marijuana.
“There was zero consent,” the woman’s attorney Michael David told the New York Post. “The cops were over 6 feet tall. She’s very petite, like 5-2 and maybe 100 pounds. There’s nothing she could do.”
The incident took place on September 15 in the parking lot of a Chipotle on Coney Island in Brooklyn after two plainclothes detectives pulled a car over.
The Daily Mail says the cops pulled the car over after spotting the woman smoking Marijuana. The New York Post said the cops found prescription drugs in the car.
Inside the car with the woman were two men, but police let them drive away after taking the woman into custody for the drugs.
The cops then ordered her to undress to search for more drugs but did not find any.
However, they then placed her inside an unmarked police van where one cop raped her. They then both forced her to perform oral sex on them in exchange for not jailing her, according to her lawyer.
“You’ll spend three hours in the precinct,” they allegedly told her, according to the lawyer “This is what you’re going to do for us, and we’ll let you go.”
The woman then sought help from NYU Langone Hospital and spoke to a friend about the incident. She also reported the incident to the cops, who are now investigating the allegations. Also investigating is the Brooklyn District Attorney’s Office.
Her lawyer has filed a notice of claim, which must be done before filing a lawsuit.
UPDATE: The two cops have been identified as Richard Hall and Edward Martins. Both have been stripped of their guns and badges and placed on desk duty, according to the New York Post.
Their supervisor, Sergeant John Epsey, was also stripped of his badge and placed on desk duty for “failing to supervise.”
The woman has posted publicly about the incident on her social media accounts where she goes by Anna Chambers.
“SHARE THIS, yes its about me,” the 18-year-old woman tweeted, linking to a Post article about her claims.
“Justice needs to be served,” she added in another post.
The teen is reportedly shocked that the detectives would claim it was consensual, said her lawyer, who confirmed the woman tweeting was his client.
“She just wants everybody to know it’s an absolute lie,” her attorney told the Post. “She was viciously, brutally raped in handcuffs.’’
The Post interviewed one of the friends she was with the night cops arrested her, a 24-year-old man who was not arrested even though he said police found Prozac on him.
But they did arrest her after finding Klonopin pills inside her purse.
“They said she’s not allowed to have them outside the bottle, they’re a controlled substance, and she has to go to the precinct,” he recalled Friday. “I saw them put her in cuffs. She was like, ‘Are you serious?’ ”
The cops told the man that they were taking the teen to the 60th Precinct station house while letting him go, he said.
Her male friend said he went to the station house about a half-hour later and was told no one had been brought in. He left and found her waiting by his car, visibly upset.
“Her hair was a mess, and she ran up to me and gave me a hug, and she was like, ‘They f–ked me. They f–ked me,’ ” he said. “
‘They forced me to have sex with them.’ She was like, ‘I can’t believe this is happening.’ She asked me if I should tell her parents, and I was like, ‘Yeah.’ ”
Her friend drove her home, then to the hospital with her mother where doctors examined her and found signs of sexual assault, according to the New York Daily News.
The hospital called police, prompting an internal affairs investigation.
